Terms of Service

1. Acceptance of Terms

By accessing or using the Heartland Machinery Auctions website, creating an account, or participating in any auction, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Account Registration

To participate in auctions, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials. You may register using email/password or through third-party authentication providers (Google, Facebook). You must be at least 18 years old to create an account.

3. Bidding and Purchases

• All bids are binding and irrevocable once placed.
• The highest bidder at the close of an auction is the buyer.
• A Buyer's Premium may be added to the final bid price as specified in each auction's terms.
• Sales tax will be applied as required by applicable law.
• Heartland Machinery Auctions reserves the right to reject any bid or cancel any sale at its sole discretion.

4. Payment

Payment is due within the timeframe specified in each auction's terms and conditions (typically 3 business days). Accepted payment methods include bank wire transfer, certified check, and credit card (subject to limits and processing fees as stated in auction terms). Items will not be released until payment is received and cleared in full.

5. Item Condition and Inspection

All items are sold AS IS, WHERE IS, WITH ALL FAULTS unless otherwise stated. Descriptions and photographs are provided as a guide only. Buyers are strongly encouraged to inspect items prior to bidding. All sales are final — no returns, refunds, or exchanges.

6. Removal of Items

Buyers are responsible for removing purchased items within the deadline specified in each auction's terms. Items not removed by the deadline may be subject to storage fees. Removal is the sole responsibility of the buyer, including arranging transportation.

7. User Conduct

You agree not to:

• Provide false or misleading information
• Bid without the intent or ability to pay
• Interfere with the operation of auctions or the platform
• Use automated systems to place bids or access our services
• Violate any applicable laws or regulations

8. Account Suspension

We reserve the right to suspend or terminate any account that violates these terms, engages in fraudulent activity, fails to complete payment, or otherwise abuses our platform. Blocked users will not be permitted to bid in future auctions.

9. Limitation of Liability

Heartland Machinery Auctions, LLC acts as an auctioneer and facilitator. We are not responsible for the condition, quality, or fitness of items sold. Our liability is limited to the fees collected for our services. We are not liable for any indirect, incidental, or consequential damages arising from the use of our platform or participation in auctions.

10. Changes to Terms

We may update these Terms of Service at any time. Continued use of our services after changes are posted constitutes acceptance of the updated terms. Material changes will be communicated via email or notice on our website.

11. Governing Law

These terms are governed by the laws of the State of Nebraska. Any disputes shall be resolved in the courts of Douglas County, Nebraska.
